No appeal lies against Khula

PLJ 2010 Peshawar 97 (DB) · Peshawar High Court

This case involved a husband and wife whose marriage ended in dissolution through khula (a wife's right to end her marriage), granted by a Family Court. The trial court had ordered dissolution of the marriage, return of dowry articles, and maintenance for the wife during her iddat period, but did not award her the dower amount since the marriage ended through khula.

The wife appealed, and the appellate court reversed course, awarding her the dower amount of Rs. 150,000 along with maintenance. The husband then challenged this appellate decision before the Peshawar High Court, arguing that a khula-based dissolution cannot be appealed, and that by awarding dower, the appellate court was effectively overturning the khula itself.

The High Court agreed with the husband. It held that no appeal lies against a judgment dissolving a marriage, whether based on cruelty or khula. Since the question of dower was closely tied to the basis of the khula, the appellate court could not grant dower without indirectly interfering with the dissolution itself. The High Court ruled that the appellate court had wrongly acted like a religious judge (qazi) rather than staying within its proper appellate role, and that its order granting dower was without jurisdiction.

The High Court therefore set aside the dower award but upheld the maintenance allowance. This case clarifies an important principle in Pakistani family law: decisions dissolving marriages via khula are final and cannot be appealed, even indirectly through related financial claims.
