Right to sue in case of Benamidar has six years limitation
PLJ 2010 Karachi 132 · Sindh High Court
This case is about a dispute between brothers over a plot of land in Karachi. The plaintiff claimed he had paid for a plot allotted in his brother's name (a "benami" arrangement, where one person holds property in trust for another), and that his brother had acknowledged this through a gift declaration and other documents. While the plaintiff was posted abroad for his job, his brother allegedly acted dishonestly, got the plot transferred to a third party using forged documents, and the property changed hands multiple times through the city development authority.
The plaintiff sued for declaration of ownership and cancellation of the wrongful transfer. A single judge of the Sindh High Court dismissed the suit, ruling it was filed too late under Article 91 of the Limitation Act, which allows only three years to challenge a document.
On appeal, a two-judge bench disagreed. They held that Article 91 didn't apply here since the plaintiff wasn't simply challenging a document but asserting his ownership against someone holding property in trust (a benamidar). The correct limitation period was six years under Article 120, running from when the plaintiff discovered his brother's hostile claim to ownership. Calculating from the relevant dates, the suit was filed within time.
The appeal was allowed, the dismissal was overturned, and the plot was ordered to be registered in the plaintiff's name. The case clarifies that disputes between real owners and benamidars get a longer six-year limitation period, not the shorter three-year period for cancelling documents.
