Freedom of Travel is denied when name is placed in ECL
PLJ 2010 · Sindh High Court
This case concerns Mian Munir Ahmed, whose name had been placed on Pakistan's Exit Control List by the Ministry of Interior, preventing him from leaving the country. He challenged this before the Sindh High Court under Article 199 of the Constitution, arguing it violated his fundamental right to freedom of movement.
The government had listed him based on a recommendation from the FIA and State Bank because he was considered a loan defaulter, and because several civil and criminal cases were pending against him related to a company, Central Cotton Mills Limited, where he had been a director. His lawyer pointed out that most of these 25 cases had already been disposed of, only a handful remained pending, and the State Bank itself had not recommended including him in a later, revised list.
The court found two key problems with how the government acted. First, the notification placing him on the list gave no reasons at all, meaning he was never given a chance to respond or defend himself before action was taken against him. Second, the court reaffirmed settled legal principle that merely having pending civil or criminal cases is not sufficient grounds to restrict someone's constitutional right to travel.
While the court acknowledged the government does have legal authority under the Exit from Pakistan (Control) Ordinance, 1981 to restrict travel, it ruled this power cannot be used arbitrarily or without fair hearing. The court allowed the petition, permitting Ahmed to travel freely. The case matters because it reinforces that travel restrictions require due process and genuine justification, not blanket assumptions tied to unresolved litig
