Quashment in Qazf Case

PLJ 2010 Cr.C. ( · Lahore High Court

This case involves a complaint filed by Dr. Maqsood Hussain against 36 people, asking the court to convict them for qazf (false accusation of zina, or unlawful sexual intercourse, under Islamic criminal law) for allegedly spreading claims that he had committed zina-bil-jabr (rape). This stemmed from an earlier case where a woman, injured in the 2005 earthquake and being treated in Lahore, had accused Dr. Maqsood of assault, leading to an FIR against him. She later said media persons had pressured her into making the complaint and asked that it be withdrawn; the original case against the doctor was eventually cancelled.

When Dr. Maqsood later filed his qazf complaint, the Additional Sessions Judge handling it adjourned the case repeatedly, often without proper reason, and eventually issued arrest warrants against the accused persons without properly following the law. The High Court found that the trial judge had violated Section 200 of the Criminal Procedure Code, which requires a magistrate to examine a complainant under oath and record the statement properly before proceeding. This had not been done.

The High Court also found that, based on the complaint and the woman's own statement, no actual offence of qazf had been established against the accused. For these reasons, the court declared the lower court's proceedings and warrants illegal and quashed them.

This case highlights the importance of following proper procedure before issuing serious orders like arrest warrants, and clarifies that criminal accusations must be backed by clear evidence of an actual offence.
