Rule of consistency possible in pre-arrest bail
PLJ 2010 Cr.C. (Lahore) 860 · Lahore High Court
This case involved a man accused of contracting a second marriage with a woman while her earlier marriage was allegedly still valid. He was initially charged under sections of the Pakistan Penal Code dealing with cheating, forgery, and impersonation (419, 420, 468, 471), based on an FIR registered against him. A magistrate had granted him post-arrest bail, but an Additional Sessions Judge later recalled that bail, partly citing concerns about a date discrepancy in the bail order.
The petitioner challenged this cancellation before the Lahore High Court. His lawyer argued that the marriage was properly recorded, not secret, that the woman's earlier marriage had already been dissolved by the time of the FIR, and that co-accused in the same case had already been granted bail, so he deserved the same treatment under the "rule of consistency." The state's own prosecutor agreed that the serious offenses alleged did not actually apply to the facts, and at most a lesser offense (bigamy-related, under section 495) was relevant.
The High Court found that the Additional Sessions Judge had acted beyond his authority in cancelling the bail, especially over a mere clerical date error that had already been corrected. It also held that since co-accused had been granted bail, consistency required the same relief for this petitioner. The court set aside the cancellation order and confirmed the petitioner's pre-arrest bail, subject to furnishing bail bonds. The case highlights that courts must apply the rule of consistency even in pre-arrest bail matters, and bail should not be cancelled
