Court can accept or reject forensic report
PLJ 2010 Cr.C. (Lahore) 752 (DB) · Lahore High Court (Rawalpindi Bench)
This case was heard by the Lahore High Court, Rawalpindi Bench, on appeal from a trial court decision in Chakwal where Kazim Hussain Shah had been convicted of murdering four people, Ghulam Sakeena, Misbah Batool, Khadim Hussain, and Bareen Fatima, and sentenced to death on each count, plus a separate conviction for house-trespass. Two other men initially accused in the same incident had already been acquitted at trial after police found no evidence linking them to the crime and no recoveries were made from them.
The prosecution's case against the appellant rested heavily on recovered crime-scene evidence, including spent cartridges, and a positive report from the Forensic Science Laboratory supposedly linking a recovered pistol to the shootings. The High Court examined this evidence and found it unreliable, choosing to reject the forensic report rather than accept it, noting that such technical reports are not automatically binding on a court. The judges reasoned that since two co-accused on the same evidence had already been acquitted, and there was no strong independent corroboration tying the appellant specifically to the killings, it would be wrong to uphold a death sentence based on weak proof.
The court ultimately set aside the conviction and death sentence, granting the appellant the same benefit of doubt extended to the acquitted co-accused. This case is significant because it confirms that courts are not obligated to accept forensic or scientific reports at face value and must still weigh them against the overall strength and consistency of the evidence before convicting someone, especially in cap
