Circumstantial evidence matters a lot in murder case

PLJ 2010 Cr.C. (Lahore) 50 (DB) · Lahore High Court (Multan Bench)

This case involved a man, Muhammad Ramzan, convicted of murdering his wife, Mst. Sakina Bibi, and sentenced to death by a trial court in Khanewal. The prosecution alleged that the killing happened at night in the bedroom of the wife's father, where the husband was living as a "ghar damad" (resident son-in-law). The father, an uncle, and another relative claimed to have witnessed the murder, saying the husband attacked his wife with a hatchet after a quarrel over gold ornaments, then escaped.

On appeal, the Lahore High Court closely examined the circumstances. It found that the couple had actually married for love against the father's wishes, and that the father had earlier filed (and later withdrawn) a criminal case accusing the husband of abducting his daughter. The court found it unbelievable that a father from a conservative rural background would let his daughter's love-marriage husband live in his own home, and equally implausible that the husband could kill her in a small, one-door room in front of three relatives and still escape unseen. Given the severe, multiple injuries and the fact that the killing was actually unwitnessed, the judges concluded this looked more like an "honour killing" by the family than a killing by the husband.

Since the prosecution failed to prove the case beyond reasonable doubt, the court acquitted the appellant, reaffirming that any genuine doubt must benefit the accused. The case highlights how careful scrutiny of circumstantial evidence and witness credibility can overturn even a death sentence.
