Shahbaz Sharif's Case Judgment

PLJ 2009 SC 711 · Lahore High Court

This case involved a legal challenge over whether Mian Muhammad Shahbaz Sharif could validly contest and hold office as Chief Minister of Punjab, based on questions about his qualifications under the Constitution and election laws. A citizen had raised objections during the nomination process, arguing that Shahbaz Sharif had made statements prejudicial to the judiciary's independence and had submitted an incorrect declaration, which could disqualify him under Articles 62 and 63 of the Constitution. These objections went through the Election Tribunal and Election Commission, and eventually to the Lahore High Court, which ruled in his favor and allowed him to continue functioning as Chief Minister. The Federation and others then challenged that High Court decision before the Supreme Court.

The Supreme Court examined technical questions about election law, particularly the difference between two provisions, Section 14(5) and Section 14(5-A), of the Representation of the People Act, 1976. It held that ordinary citizens have the right to bring information about a candidate's disqualification to an Election Tribunal, that such challenges are not bound by the strict time limits meant only for formal appeals, and that the word source in the law covers both individuals and organizations. The Court also confirmed that a citizen could challenge a candidate's qualifications through a writ petition even before elections were completed. Ultimately, the Supreme Court agreed with the High Court's reasoning and upheld its decision, reinforcing accountability and transparency in the electoral process.
