Who has to check the status of case at High Court?
PLJ 2009 SC 272 · Balochistan High Court
This Supreme Court of Pakistan judgment deals with a landlord-tenant dispute from Quetta. The landlord, Malik Muhammad Qasim, had sought eviction of his tenants, Ghulam Siddique and another, from a shop and house, citing rent default, personal need, and subletting. The Rent Controller ordered the tenants' eviction in 2007. The tenants appealed to the Balochistan High Court, but their appeal was dismissed because it was filed late, and the High Court refused to excuse (condone) the delay.
The tenants then approached the Supreme Court, arguing that their late appeal should have been excused and the case decided on its merits rather than being thrown out on a technicality. They suggested the delay was not really their fault.
The Supreme Court disagreed and refused to grant leave to appeal, upholding the High Court's decision. The Court emphasized an important principle: litigants cannot simply hire a lawyer and then walk away from responsibility for their own case. Even if a lawyer fails to keep a client updated, that negligence does not automatically excuse delays, especially once the opposing party has gained valuable rights through the passage of time. It is the litigant's own duty to stay informed about what is happening with their case in court.
This ruling matters because it reinforces that clients, not just their lawyers, bear responsibility for diligently pursuing legal proceedings, and that missed deadlines can have serious, irreversible consequences. The tenants were given nine months to vacate the premises.
