When Qazf Proceedings can be initiated?

PLJ 2009 SC 1146 · Islamabad High Court

This case concerns Qazf, the Islamic law offence of falsely accusing someone of adultery (zina) without producing the required evidence. The Pakistan Shariat Appellate Bench of the Supreme Court heard a petition from a husband, Haji Bakhtawar Said Muhammad, challenging a Federal Shariat Court decision against him.

After divorcing his wife, Dur-e-Shahwar Begum, the husband allegedly told her relatives and notables who came to arrange reconciliation that she was of bad character and that their three children were illegitimate, the result of adultery. He repeated similar allegations in written statements filed in separate maintenance and dower-recovery court cases. His wife filed a criminal complaint accusing him of Qazf under Pakistan's Offence of Qazf Ordinance, 1979.

The husband argued that since she was his wife, any such accusation should instead fall under separate legal rules for spouses (li'an), not ordinary Qazf, and that his later statements were merely repetitions of an earlier claim. The Court rejected this argument, holding that by the time he made these accusations, the couple was already divorced, so they were no longer husband and wife. This meant the special spousal provision did not apply, and his conduct squarely fell under the general Qazf provisions (Sections 6 and 7), since he was accusing a woman who was no longer his wife of adultery without proof.

The Court upheld the Federal Shariat Court's order directing that formal Qazf charges be framed and the case proceed to trial.
