Burden of Proof in case of non custom paid vehicle
PLJ 2009 Quetta 76 (DB) · Balochistan High Court
This case is about a Mitsubishi Pajero Jeep that was stopped in Quetta in 1999 because its chassis number appeared to have been tampered with. Customs officials, acting on intelligence, seized the vehicle after examination suggested it had been smuggled into the country and its chassis number altered to avoid detection. The Additional Collector of Customs ordered the vehicle confiscated, and this decision was upheld by the Customs Appellate Tribunal. The vehicle's possessor then challenged this before the Balochistan High Court.
The main legal question was who bears the burden of proving a vehicle was legally imported: the customs authorities, or the person possessing the vehicle. The applicant argued customs had failed to prove the vehicle was fake or smuggled, and also claimed the show-cause notice was issued late.
The High Court rejected both arguments. It held that under Section 187 of the Customs Act, 1969, once someone is found in possession of goods and a question arises about lawful authority or import, it is that person's responsibility to prove they lawfully imported the item and paid applicable customs duties and taxes - not the other way around. The court also found that the notice had in fact been issued within the legally required time frame. As a result, the confiscation order was upheld, and the reference was decided against the applicant.
This case is significant because it clarifies that individuals possessing vehicles suspected of being smuggled must prove legal ownership and importation, rather than requiring customs authorities to prove illegality.
