Court fee in cases of family suits
PLJ 2009 Lahore 780 · Lahore High Court (Multan Bench)
This case involves a husband challenging a family court decision that ordered him to return dowry articles worth Rs. 2,00,000 to his former wife.
The wife had filed a suit after her marriage broke down within a month, alleging mistreatment and false adultery accusations. She sought dissolution of marriage, maintenance, and recovery of dowry items she brought to the marriage. The Family Court ruled in her favor on the dowry claim, and this was upheld on appeal.
The husband then approached the Lahore High Court, arguing that the lower courts had made errors, including failing to properly consider that the suit's stated value was lower than the amount awarded, and that some evidence was allegedly forged.
The High Court rejected these arguments. It examined the evidence and found no errors or jurisdictional problems in the lower courts' decisions. Importantly, the court clarified a legal point: under the West Pakistan Family Courts Act, 1964, suits involving dowry articles are exempt from court fees that would normally apply under the Court Fees Act. This is because "dowry" cases fall within a special category of matters family courts handle, and the law specifically exempts such suits from court fee requirements, even when a monetary amount is claimed as an alternative to returning physical items.
The petition was dismissed, and the husband was ordered to pay Rs. 5,000 in costs to his former wife. This ruling reinforces that dowry recovery suits enjoy special fee exemptions, making it easier and less costly for women to reclaim dowry articles through family courts.
