Criminal Case cannot be stayed for civil litigation

PLJ 2009 Lahore 316 · Lahore High Court (Multan Bench)

This case involved a criminal complaint arising from a property dispute. Khadim Hussain and others were accused of trespassing on a field, damaging crops, and stealing fertilizer and wheat, leading to an FIR being registered against them in 1997. The accused argued that the land was theirs and that a related civil suit over ownership and possession was still pending between the parties. Based on this, a magistrate had adjourned the criminal case indefinitely to wait for the outcome of the civil litigation, without deciding the accused's application for acquittal under Section 249-A of the Criminal Procedure Code. An Additional Sessions Judge later set aside that order and directed the trial to proceed, prompting the accused to challenge this decision before the High Court.

The Lahore High Court dismissed the petition, ruling that criminal cases cannot be put on hold simply because a related civil case is ongoing. The court explained that civil and criminal proceedings are separate in nature and must be decided independently, based on the evidence presented in each. The accused could still present ownership documents as part of their defense during the criminal trial, but this did not justify stalling the criminal proceedings altogether.

However, the court noted that the magistrate had never actually decided the accused's acquittal application on its merits, and the sessions judge had overlooked this. So while the criminal trial was allowed to resume, the trial court was directed to first decide the pending acquittal application before moving forward. This case clarifies that pending civil disputes cannot be used as grounds to indefinitely delay criminal trials.
