Presence of prosecution witnesses is important in criminal case

PLJ 2009 FSC 41 · Federal Shariat Court

This case from the Federal Shariat Court involved a man, Saeed Ullah, who was convicted of murder and sodomy of a six-year-old boy, the son of his landlord. He was sentenced to life imprisonment and ordered to pay compensation. Two co-accused, his wife and minor son, had been acquitted by the trial court. Multiple appeals arose: Saeed Ullah appealed his conviction, the complainant appealed against the acquittals of the other two accused, and the state sought enhancement of Saeed Ullah's sentence to death.

The Federal Shariat Court examined the evidence closely and found serious problems with the prosecution's case. The complainant's initial report and the police inquest report did not mention key witnesses who later claimed to have seen the accused near the scene, raising suspicion about their credibility. The recovery of the child's body was not properly proven, and a key witness who claimed to have seen the accused carrying a sack was found to be a "chance witness" whose presence at the scene was doubtful. The court noted the incident was unseen by anyone, and there was no solid evidence linking Saeed Ullah to the crime beyond unreliable testimony.

The court ruled that the prosecution had failed to prove guilt beyond reasonable doubt, and acquitted Saeed Ullah. This case highlights the importance of reliable witness testimony, proper documentation like inquest reports, and the principle that convictions cannot rest on suspicion or weak evidence.
