Delay in FIR can lead to acquittal of accused
PLJ 2009 FSC 237 · Federal Shariat Court
This case involved a private complaint filed by a father, Nazar Hussain, alleging that his minor daughter Tasleem Mai was abducted by Safdar Hussain and Bilal with the intent of committing Zina (unlawful sexual intercourse) under Pakistan's Hudood laws. After police investigation, one accused, Bilal, was found not involved, while the other, Safdar Hussain, was tried for the offence. The trial court ultimately acquitted both accused, noting that the alleged victim herself retracted her earlier statement during re-examination, saying it had been made under coercion and that no Zina had occurred. The court also noted a five-month delay in registering the FIR and found the medical evidence inconclusive, with other inconsistencies undermining the prosecution's case.
The complainant then sought special leave to appeal the acquittal before the Federal Shariat Court. The Court dismissed the petition, holding that an appeal against acquittal can only succeed if there is clear evidence of misreading or disregard of material evidence leading to a miscarriage of justice. Since the complainant's petition failed to challenge key findings of the trial court-particularly the victim's retracted statement-and showed no such error, the acquittal was upheld.
The case illustrates how delays in registering an FIR, inconsistent evidence, and retraction of statements by a complainant can weaken a prosecution's case, and reaffirms the principle that appellate courts are cautious about overturning acquittals without strong justification.
