What to do if police detains someone wrongly?

PLJ 2009 Cr.C. ( · Lahore High Court

This case is about two people, Aamir, a 12-year-old student, and his father Nazir, who were detained by police in Nankana Sahib without proper legal procedure. Police had raided their home seeking a proclaimed offender, Nazir's other son, and in the process took away the boy, his father, two women, and two cows. The women were released, but Aamir and Nazir were held in illegal custody for days without their arrest being recorded or being produced before any court, as required by law.

The Lahore High Court sent a bailiff to recover them. Medical examination showed clear signs of brutal torture. The court found that although Aamir was technically named in an FIR, both detentions were illegal since proper procedures were ignored. Importantly, Nazir himself was not even accused of any crime; he was held merely to pressure information about his absconding son, which the court said was unacceptable because no one can be punished or tortured for a relative's alleged crimes.

The court ordered both detainees released, converted the habeas corpus petition into a bail matter for Aamir, and awarded compensation to be paid by the responsible police officers for illegal detention and torture. It also directed the Inspector General of Police to take disciplinary action against the officers involved under relevant police accountability rules, emphasizing that illegal detention and torture violate fundamental constitutional rights and international human rights standards.
