What happens iIf police makes a strong and true case?
PLJ 2009 Cr.C. ( · Lahore High Court
This case involved Malik Khalid Hussain, who was convicted and sentenced to life imprisonment plus a fine under Pakistan's narcotics law after police allegedly recovered 80 kilograms of poppy straw (narcotics) from a house following a raid based on secret tip-off information. According to the prosecution, police spotted the appellant and a co-accused, who fled when the raiding party arrived, leaving behind two bags of poppy straw.
On appeal, the defense argued that all witnesses were police officials, that police had entered the house without a magistrate's permission, that no identification parade was held since the appellant was unknown to police beforehand, and that no evidence linked the house to the appellant.
The Lahore High Court rejected these arguments and upheld the conviction. The court held that police witnesses are just as credible as any other public witnesses, citing Supreme Court precedent. It found the two police witnesses' testimony consistent and credible, with no major contradictions. The court also noted that ordinary members of the public are often reluctant to testify in such cases out of fear of retaliation from accused persons, which explained the absence of independent witnesses. Since the defense could not show any enmity motivating the police to falsely implicate the appellant with such a large quantity of narcotics, the court dismissed the appeal and upheld the conviction and life sentence. This case matters because it reinforces that police testimony alone, if credible and consistent, can sustain a narcotics conviction.
