Confirmation of death sentence in law
PLJ 2009 Cr.C. (Lahore) 987 (DB) · Lahore High Court (Rawalpindi Bench)
This case, decided by the Lahore High Court's Rawalpindi Bench in 2009, involved Muhammad Sarfraz, who had been convicted by a trial court of murdering his nephew (his sister's son, Mumtaz Khan) and attempting to murder two other nephews during an argument over a money dispute. The trial court had sentenced him to death for murder, along with separate additional sentences for the attempted murders and various injuries caused to the surviving victims. The High Court was reviewing both his appeal and the mandatory reference for confirmation of the death sentence.
The High Court upheld his conviction for murder but refused to confirm the death penalty, converting it instead to life imprisonment. The judges found several mitigating factors: there was no prior enmity between the appellant and his nephews, who were in fact on cordial terms with him; the shooting occurred as a sudden, unexplained emotional outburst during a friendly conversation about an old business debt; and the record did not clarify what specifically triggered the violence. The court also held that since all the injuries occurred during a single continuous incident, the appellant could not be separately punished for each injury - only the most serious one counted.
This judgment matters because it illustrates how Pakistani courts weigh mitigating circumstances - such as the absence of premeditation, family relationship, and sudden provocation - when deciding whether a death sentence is truly warranted, even after a murder conviction is confirmed.
