This case involved a father, Shabbir Hussain, accused under Section 376 of the Pakistan Penal Code of committing rape against his own minor daughter. The complaint was filed by the girl herself, alleging the assault occurred while she was alone at home. The accused sought post-arrest bail, arguing he had been falsely implicated due to a family dispute: he claimed the real issue was that the girl had developed an inappropriate relationship with a relative's son, and to protect that young man, the girl's grandmother and aunt orchestrated a false case against him.
The Lahore High Court, Multan Bench, examined the record and found several reasons to doubt the prosecution's version. The medical evidence did not clearly support the victim's account, and chemical examination results were still pending. The father had seven children living in the same house, making it seem improbable he would commit such an act in their presence. Notably, the victim had refused to meet her own mother and preferred staying with her grandmother and aunt, the very relatives suspected of pressuring her to make the allegation. The court noted that a young, poorly educated girl could easily be influenced by relatives.
Given these contradictions, the court ruled the matter required further inquiry rather than definite guilt, and granted bail since the accused had already been detained for six months. The court also ordered police protection for the victim and directed an independent inquiry into the allegations.
