An innocent person cannot be tortured or detained illegally
PLJ 2009 Cr.C. ( · Lahore High Court
This case involved a habeas corpus petition filed by Azmat Bashir on behalf of his brother, Mazhar Bashir, who had been illegally detained by police. Mazhar was arrested from his home in Okara by a police sub-inspector, not because he had committed any crime, but because his two brothers were allegedly involved in criminal cases and one was absconding. He was held for 20 days without being produced before any court, was not named in any FIR, and his arrest was never officially recorded. Medical examination confirmed he had been physically tortured, apparently to force him to reveal his absconding brother's whereabouts.
The Lahore High Court, acting under Section 491 of the Criminal Procedure Code, ordered the detenu's recovery through a court bailiff, who found him hidden at a police station. After hearing the police officers involved, who could not justify their actions, the court ordered Mazhar's immediate release. It ruled that no person can be punished or tortured for a crime committed by a relative, and that such treatment violates both the Constitution's guarantees of life and liberty and international human rights law.
The court awarded compensation of Rs. 50,000 and Rs. 25,000 to be paid personally by the two police officers responsible, acknowledging that no sum could truly compensate for lost freedom and suffering. It also directed the Inspector General of Police Punjab to take disciplinary action against the officers, emphasizing that illegal detention and torture of innocent citizens cannot be tolerated.
