Contents of Plaint are important for Rejection of Plaint
PLJ 2009 · Sindh High Court
This case was decided by the Sindh High Court and involved a company, Sunley Developers, suing Mumair Associates over a housing scheme called Gulshan-e-Rumi in Karachi. Sunley claimed it had signed an agreement in 1998 to buy land for 950 residential plots, paid a large sum of money, and was given possession, but the defendant failed to obtain necessary approvals, complete development work such as roads and boundary walls, and honor the agreement. Sunley sued for specific performance of the contract, declaration, and injunction. The defendant asked the court to reject the plaint outright, arguing the suit was time-barred and that the plaintiff had no valid cause of action.
The court explained that when deciding whether to reject a plaint, it must assume the plaint's contents are true and can only reject it if the plaint itself clearly shows the claim is barred by law, such as limitation. Here, the court found the agreement, despite being called an "agreement to sell," was actually a complete transfer of the land with full power of attorney given to the plaintiff to sell plots itself. Since all the obligations complained about were actually duties of the plaintiff, not the defendant, there was no real grievance against the defendant. The court also noted the agreement failed to clearly identify the land's lease details. As a result, the court allowed the application and rejected the plaint. The case highlights how courts closely examine the actual wording and substance of an agreement, not just its title, when deciding whether a lawsuit can proceed.
