Judgment on Sindh Local Government Ordinance
PLJ 2008 SC 969 · Sindh High Court
This case involved a dispute over a no-confidence (recall) motion against the Zila Nazim (district mayor) of Sukkur under the Sindh Local Government Ordinance, 2001. Two council members had issued a recall notice against the Zila Nazim, alleging he was acting against public interest. When the council meeting was convened to consider the motion, it had to be adjourned because there was no quorum present. The Zila Nazim argued that since the law did not require a quorum for such a meeting, the adjournment meant the recall motion should be treated as automatically considered and rejected, which would have let him keep his position without further challenge. The High Court of Sindh had rejected this argument, and he appealed to the Supreme Court.
The Supreme Court upheld the High Court's decision. It ruled that a recall motion must actually be put to a vote as required by Section 24(3) and (4) of the Ordinance; if a meeting is adjourned without voting, the motion remains pending rather than being deemed rejected. The Court also held that internal council bye-laws cannot override the clear requirements of the Ordinance, and that courts should generally avoid interfering in the internal business of elected local bodies unless there is a genuine legal violation.
This decision mattered because it clarified the correct legal procedure for handling no-confidence motions against local government heads, ensuring that recall motions are properly voted on rather than dismissed on technical grounds, thereby protecting the democratic process of accountability within local councils.
