Can police raid without search warrants?
PLJ 2008 SC 414 · Lahore High Court (Rawalpindi Bench)
This case involved Arshad Mahmood, who was convicted under the Control of Narcotic Substances Act, 1997 for possession of charas (hashish) and sentenced to life imprisonment with a heavy fine. Police had raided his house in Islamabad in 2000 based on secret tip-off information, without first obtaining a search warrant from a magistrate, and recovered over 21 kilograms of charas from the courtyard. His wife, who was present at the time, was arrested on the spot but later acquitted, while the appellant himself was said to have fled before police arrived.
The Supreme Court examined whether such warrantless raids on private homes violate Article 14 of the Constitution, which protects the dignity and privacy of citizens. The Court held that police and similar agencies do not have unlimited power to search a person's home without satisfying legal requirements, even when a magistrate accompanies the raiding party. The presence of a magistrate does not excuse police from the mandatory legal duty to obtain a search warrant when there was time and opportunity to do so.
The Court also found no proof that the house was in the appellant's exclusive possession, and noted the inconsistency of acquitting the wife while convicting the husband based on the same recovery. As a result, the conviction and sentence were set aside.
This judgment is important because it reinforces that constitutional protections of privacy limit police search powers, and that procedural shortcuts cannot override an individual's fundamental rights.
