Forthwith means without further adjournment
PLJ 2008 SC 1059 · Lahore High Court (Rawalpindi Bench)
This case concerns a dispute over agricultural land where the respondent, Nazir Ahmed, had filed a civil suit claiming a right of pre-emption to purchase land that Muhammad Aslam had acquired. During the trial, the plaintiff repeatedly failed to produce his evidence due to various delays, including judges being transferred and adjournment requests. Eventually the trial court invoked Order XVII, Rule 3 of the Civil Procedure Code to close the plaintiff's evidence and dismissed the suit with costs. On appeal, the Additional District Judge set aside this dismissal and sent the case back for a fresh decision, and the Lahore High Court upheld that decision. Muhammad Aslam then challenged this before the Supreme Court.
The Supreme Court dismissed the petition, clarifying an important legal point: when a law says a court must proceed to decide a matter forthwith, this does not mean the court must immediately dismiss the suit. It only means the court should proceed without further adjournment to take the next appropriate step. In this case, since the plaintiff himself was present in court on the relevant date, the trial judge should have called him to testify directly instead of dismissing the entire suit. This ruling matters because it protects litigants from losing their case outright due to procedural technicalities when alternative, fairer options were available to the court.
