Family suits can be consolidated
PLJ 2008 Lahore 513 · Lahore High Court (Rawalpindi Bench)
This case involved a family dispute in the Lahore High Court, Rawalpindi Bench. A woman, after being divorced, filed a single consolidated lawsuit in the Family Court claiming dowry articles, maintenance, and dower (mehr) from her ex-husband. Her former mother-in-law, acting as attorney for her son, objected, arguing that under Section 17 of the West Pakistan Family Courts Act, 1964, such claims could only be combined into one suit if it was specifically a suit for dissolution of marriage—not otherwise. When the Family Court judge rejected this objection, the mother-in-law challenged that ruling through a constitutional petition in the High Court.
The High Court dismissed the petition for two reasons. First, it held that a constitutional petition cannot be filed against a mere interim (temporary) order of a lower court—only final orders can typically be challenged this way. Second, on the merits, the court found nothing wrong with combining the claims. Since the woman was already divorced, she had no choice but to file one combined suit for all her claims. The court also noted that even if separate suits had been filed, the Family Court had the power to consolidate them anyway to serve justice and avoid delay.
This judgment matters because it confirms that Family Courts can combine related claims into a single case to make proceedings more efficient, and that parties cannot use technical objections or interim orders to stall justice. The petitioner was also ordered to pay costs for delaying the case.
