Recovery of Minor Children through Habeas Corpus

PLJ 2008 Cr.C. ( · Lahore High Court (Rawalpindi Bench)

This case concerns a mother's petition before the Lahore High Court seeking the recovery of her two minor children, a daughter and a son, from the custody of their paternal uncle and grandmother. She alleged that after her husband disappeared (following an abduction in 1997), his relatives took her dowry items and the children away to Rawalpindi, later pressured her to marry her brother-in-law, and threw her out without the children when she refused.

The respondents countered that they took responsibility for the mother and children after the husband's disappearance, enrolled the children in good schools, paid for their education, and that the children were thriving and happy in their care. They also noted that a separate guardianship case was already pending before the Guardian Court.

The court examined the facts and concluded that the children had not been forcibly or recently snatched from the mother, were not in illegal or unsafe custody, and were doing well academically while being cared for affectionately by their grandmother and uncle. It held that habeas corpus petitions under Section 491 of the Criminal Procedure Code are meant for emergency situations involving illegal custody or danger to a child's life, not for resolving ordinary custody disputes. The final determination of custody and the children's welfare, the court ruled, must be made by the Guardian Judge. The petition was therefore dismissed, leaving the custody matter to the pending guardianship proceedings.
