A sui juris Muslim Girl is entitled to set free

PLJ 2008 · Lahore High Court (Multan Bench)

This case involved a woman, Mst. Samina Nawaz, who was caught in a dispute between two conflicting marriages. She claimed she had married a man named Shehzad Afzal of her own free will, but her mother insisted she was validly married to another man, Muhammad Azam, and accused Shehzad Afzal of abducting her. While the matter was investigated, the court had ordered her placed in a women's shelter (darul-aman) pending verification of the two marriage documents, including handwriting analysis of her signatures. She later filed a case asking to be released from the shelter.

The Lahore High Court held that since the police inquiry and handwriting verification process had been completed, there was no further justification for keeping her confined. As an adult Muslim woman capable of making her own decisions, she could not be forced to stay in the shelter, nor compelled to live with either her mother or her alleged second husband against her wishes. The court ruled that only the Family Court, where she had filed a suit to annul the disputed marriage, could ultimately decide which nikah was genuine, following established Supreme Court precedent that such determinations belong to Family Courts.

The judgment matters because it reinforces that adult women have a constitutional right to personal liberty and cannot be detained indefinitely by courts or relatives simply because of unresolved marital disputes, while still ensuring the underlying legal question gets resolved through proper judicial process.
