When property cannot be partitioned its sold

PLJ 2007 Karachi 237 · Sindh High Court

This case was about a house in Gulshan-e-Iqbal, Karachi, registered in the name of Wilayat Hussain, who died in 1993. His grandchildren and daughter-in-law (the plaintiffs) sued for partition of the property, arguing it formed part of his estate and should be divided among his legal heirs.

The relatives of his other son, Anwar (the defendants), argued that although the house was registered in Wilayat Hussain's name, he was only the "ostensible" owner, while the real owner was Anwar, who had paid most of the purchase price and funded the construction. They claimed Wilayat Hussain had verbally given up his rights in the property in Anwar's favor.

The Sindh High Court rejected this argument. It held that under Section 52 of the Transfer of Property Act, any transfer of immovable property worth more than Rs. 100 must be done through a registered document. Since there was no registered transfer or relinquishment deed, the mere fact that Anwar contributed money, or that Wilayat Hussain made statements acknowledging this, could not legally make Anwar the owner. The court also explained the legal concept of "benami" transactions and found that Wilayat Hussain was the true owner, not a benamidar.

Since the property could not practically be divided among the heirs according to their shares, the court ordered it to be sold through public auction by the Official Assignee, with proceeds distributed among the rightful heirs. The case clarifies that informal arrangements or financial contributions cannot override registered ownership, and courts may order sale inst
