This case involved Ahmad Nawaz, who was convicted by a trial court in Hafizabad and sentenced to death for murdering Muhammad Mohsin in 2003, with an order to pay compensation. While his appeal was pending before the Lahore High Court, an application was filed seeking permission to compound (settle) the offence under Section 345 of the Criminal Procedure Code, based on a compromise with the victim's family.
The complication was that the murdered man's father had four wives, producing several children including daughters from earlier, divorced wives (called consanguine sisters) and a widow, Mst. Bushra Bibi, with her own children who were the deceased's full siblings. Bushra Bibi and her minor children agreed to pardon the accused and received diyat (blood money), but three consanguine half-sisters from the father's other marriages refused to compound the case.
The court had to determine who actually qualified as legal heirs entitled to grant pardon or compromise in a murder case. It ruled that only the direct heirs of the victim himself — not distant relatives or heirs of the victim's wali (guardian/next of kin) who might only inherit later — have the right to compromise under the law of qisas and diyat. Finding the compromise made by the victim's actual heirs genuine and voluntary, the court accepted it, set aside the conviction and death sentence, and allowed the offence to be compounded.
