Wife is not required to return the Gifts received before and after marriage from Husband
PLJ 2006 · Sindh High Court
This case from the Sindh High Court dealt with how family courts should handle divorce suits filed by wives seeking "khula" (dissolution of marriage at the wife's initiative). The legal question was about what happens when pre-trial conciliation between husband and wife fails in such cases, particularly regarding the law requiring courts to decide the issue of dower (mahr).
The court clarified that under the West Pakistan Family Courts Act, 1964, once pre-trial efforts fail, if the issue of dower payment is not disputed between the parties, the court should immediately pass a decree dissolving the marriage. If dower is disputed, the wife must deposit the dower amount in court before such a decree can be passed, with the dispute resolved later through evidence. If she cannot deposit it and dower remains disputed, no divorce decree can be issued until evidence is recorded.
Importantly, the court held that a wife seeking khula only needs to return or remit the dower amount — she is not required to return other gifts given to her by the husband before or after the marriage. This was supported by Islamic scholarly texts and referenced legislation on bridal gifts and dowry articles.
This judgment matters because it protects women from being wrongly pressured to return wedding gifts when seeking divorce, while also setting clear procedural rules for how family courts must process khula cases quickly and fairly.
