Allocation of Category to Ad Hoc Teacher

PLJ 2006 SC 888 · Lahore High Court (Rawalpindi Bench)

This case involved a dispute over the regularization of a government school teacher's employment status. Mrs. Zakia Latif had been appointed as a Senior English Teacher on an ad hoc basis in 1989 at an Islamabad Model School. Although she was later selected for a regular position, a government ban on appointments meant she continued working on an ad hoc basis. In 1994, the Federal Government introduced a policy to regularize ad hoc employees hired between 1981 and 1990, sorting them into two categories. The Ministry of Education reviewed her case and placed her in Category 1, the more favorable category for regularization. However, the Federal Public Service Commission (FPSC) overruled this and placed her in a different category, which led to her being denied regularization.

Mrs. Latif challenged this before the Lahore High Court, which ruled in her favor, directing that she be treated according to the category assigned by the Ministry of Education. The FPSC then appealed to the Supreme Court.

The Supreme Court upheld the High Court's decision, refusing the FPSC leave to appeal. It reasoned that since the regularization policy was made by the Government, and the Ministry of Education was a part of that same Government, the Ministry was better positioned to decide which category its own employees belonged to. The FPSC had failed to justify its authority to override the Ministry's categorization.

This case is important because it clarifies that when implementing government policies affecting employees of a specific ministry, that ministry's assessment of its own staff should generally be respected over an external body's contrary classification.
