Prior Notice before dispossessing a party
PLJ 2006 Lahore 442 (DB) · Lahore High Court (Rawalpindi Bench)
This case involved a dispute over a petrol pump and CNG station site in Islamabad. The appellant had leased the plot from the Capital Development Authority's Staff Welfare Organization for thirty years starting in 1973, building the facility at his own expense. When the lease neared expiry, the authority offered only a five-year extension at a much higher rent, which the appellant did not outright refuse but instead asked for a full thirty-year renewal, similar to what the Authority itself enjoyed under its own arrangement. Without properly resolving this, officials dispossessed him and sealed his premises, despite an earlier court undertaking that he would not be removed except through due legal process.
The Lahore High Court held that this dispossession was illegal because it violated mandatory requirements of prior notice and fair procedure. The court emphasized that public authorities must act justly, fairly, and without arbitrariness, and that courts can intervene under Article 199 of the Constitution when such fairness is breached, even in matters touching contracts, if public functionaries act unreasonably or with mala fide intent.
The court found the rejection of the appellant's extension request arrogant and improper, especially since the authority had granted itself similar long-term benefits. It ordered that possession be restored to the appellant and directed that his lease be extended for thirty years, applying principles of equity and fairness.
This case matters because it reinforces that government bodies cannot bypass fair procedure or act arbitrarily against citizens, even in contractual or quasi-contractual relationships.
