Concept of gift in Shia Law
PLJ 2006 Lahore 1040 · Lahore High Court (Multan Bench)
This case was about a dispute over agricultural land and a house in Multan, inherited from Syed Hussain Ahmad Shah, a Shia Muslim. His daughter filed a lawsuit claiming she was entitled to a share of the property, arguing that an earlier gift made by her father to his daughter-in-law in 1945 was conditional and only transferred usage rights, not full ownership, meaning the core property should eventually have passed to his legal heirs, including her.
Both the trial court and the first appellate court rejected her claim, and she challenged this before the Lahore High Court.
The High Court examined the original 1945 gift documents along with a later 1947 settlement deed in which the father himself confirmed that he had made a complete and unconditional gift. The court held that under Islamic law, once a gift of property is validly made and its corpus (the actual ownership) is transferred, any conditions attempting to control what happens after the recipient's death are void. The father could not create a new line of inheritance outside recognized legal or Islamic rules. Since the recipient had already dealt with the property for years without objection from any family member, the gift was valid and complete.
The court ruled there were no legal grounds to interfere with the lower courts' decisions and dismissed the revision petition, upholding the earlier rulings.
