Relief not prayed for can be granted

PLJ 2006 Karachi 178 (DB) · Sindh High Court

This case concerns a dispute over how the Pakistani government handled a special scheme allowing duty-free import of tractors. In 2005, the Economic Coordination Committee (ECC) of the Cabinet decided to allow a one-time import of 10,000 tractors at zero tariff, intended to benefit companies willing to set up or install tractor manufacturing in Pakistan, subject to safeguards like bank guarantees. A committee was supposed to work out detailed rules for implementing this scheme.

The petitioners, including Facto Belarus Tractors Limited, challenged the way this scheme was actually carried out. They argued that the process used to invite and select companies for the import quota was not transparent, was arbitrary, exceeded the authorities' powers, and favored certain parties over others, since some companies were granted permission while the petitioners were refused.

The Sindh High Court agreed that the entire process lacked transparency and appeared arbitrary and favoritism-driven, and did not properly follow the ECC's original decision. It quashed all the proceedings related to the tractor import scheme. Rather than simply ending the matter, the Court directed the government committee to create a proper, detailed scheme with clear criteria, conditions, and safeguards, then re-advertise the opportunity and fairly select eligible companies.

The judgment is significant because it reaffirms that courts can grant appropriate relief even if not specifically requested, and it emphasizes that public authorities must act transparently and fairly, in line with principles of good governance and the rule of law.
