Dower Amount can be enhanced by Husband during subsistence of Marriage
PLJ 2006 · Lahore High Court
This case involved a husband and wife whose marriage ended in divorce, which was later revoked after they agreed to reconcile. As part of that reconciliation, the wife claimed, the husband signed an agreement raising her dower amount from Rs. 500 to Rs. 100,000 and promising monthly maintenance for her and their son. When the husband later failed to pay, the wife sued for the dower and maintenance. The Family Court ruled in her favor, and her husband's subsequent appeal was also dismissed. He then challenged these decisions before the Lahore High Court, arguing that the agreement enhancing the dower was forged.
The High Court rejected his petition. It noted that the wife had produced the written agreement and witnesses to support it, and that handwriting comparisons by the lower courts found his signatures on the agreement matched his admitted signature elsewhere. The husband never sought expert verification to challenge this despite having opportunities to do so, which the court viewed as suspicious. Importantly, the court held that under Islamic law, a husband can voluntarily increase the dower amount at any time during the marriage, not just at the time of the nikah.
The ruling matters because it confirms that dower agreements made after marriage are legally enforceable, and courts will uphold a wife's right to such enhanced amounts when properly proven, protecting women from husbands who later try to deny commitments made to preserve the marriage.
