Custody of Minor Boy of Over 7 Years Age

PLJ 2006 · Lahore High Court (Multan Bench)

This case concerns a custody dispute over a young boy named Ali Raza, whose mother died when he was an infant. He was raised by his maternal grandmother, Mst. Jamila Bibi, until his father, Shabir Ahmad, applied to a Family Court seeking custody once the child had crossed the age of seven.

The trial court (Guardian Judge) and the appellate court both ruled in favor of the father, relying on the traditional principle from Muhammadan Law that a father is generally entitled to custody once a boy turns seven. However, they did not properly examine or record findings on whether giving custody to the father would actually serve the child's welfare, even though this was a specific issue framed for trial.

The Lahore High Court found this approach legally flawed. Citing a Supreme Court precedent (Sardar Hussain's case), the High Court held that a child's age crossing seven is not an automatic ticket to custody for the father - the paramount consideration must always be the welfare of the minor, based on evidence. Since neither lower court had properly assessed the evidence on this point, their judgments could not stand.

The High Court set aside both rulings and sent the case back to the Guardian Judge, directing it to hear both parties again and decide the matter specifically on the question of the child's welfare, within a set timeframe.

This case reinforces the principle that in custody disputes, courts must prioritize the actual best interests of the child over rigid age-based rules, even in disputes involving extended family members like grandparents.
