Contempt of Court Judgment against Lawyer
PLJ 2006 · Lahore High Court
This case from the Lahore High Court's Bahawalpur Bench dealt with a writ petition filed by a young woman, Mst. Tahira Kausar, who had married a man of her own choice against her father's wishes. Her father, a police official, had lodged a criminal case against her under the Hudood laws, and she asked the court to quash it to protect her marriage. While hearing this petition, the court became concerned about the conduct of an advocate, Mr. Riaz Hanif Rahi, who was representing her father. The judge found that instead of following proper legal procedures to seek transfer of the case to another bench, the advocate behaved in a disrespectful, aggressive, and intimidating manner in court, tried to dictate proceedings, referenced a prior unrelated order to pressure the judge into recusing himself, and generally attempted to overawe the court rather than make legitimate legal arguments.
The judge issued a detailed order describing the kinds of advocate misconduct that undermine judicial independence, including threats, disrespect, and manipulation of proceedings. The court held that such behavior potentially amounted to contempt of court. As a result, a show-cause notice was ordered to be issued to the advocate, requiring him to explain his conduct and why contempt proceedings should not be formally initiated against him under Article 204 of the Constitution and the Contempt of Court Ordinance, 2004.
This case matters because it highlights the judiciary's effort to safeguard courtroom dignity and ensure lawyers do not use intimidation or improper tactics
