Report of Handwriting Expert Obtained by High Court in a Writ Petition

PLJ 2005 · Lahore High Court

This case involved a petitioner, a retired Brigadier, who filed a writ petition in the Lahore High Court asking for registration of a criminal case (FIR) against several respondents. He alleged that his signature and that of another individual on an agreement to sell property in a Defence Housing Authority area had been forged, claiming the respondents had digitally copied his signature using computer scanning technology.

To resolve the dispute, the High Court itself took an unusual investigative step: it directed the respondents to appear in court with the original agreement to sell and the General Power of Attorney, which was an admitted document bearing genuine signatures and thumb impressions. The court then collected fresh specimen signatures and thumb impressions from the petitioner and the other individual in the presence of both parties, and sent all the material to the handwriting expert at the Federal Investigation Agency for comparison.

The expert's report concluded that the thumb impressions and signatures on the disputed agreement matched the specimen samples, based on ten identified points of similarity. Given this positive scientific finding contradicting the forgery claim, the court held there was no merit in the petition and declined to exercise its writ jurisdiction to order an FIR. The petition was dismissed, though the petitioner was left free to pursue other legal remedies such as a civil suit. The case illustrates how courts can use forensic evidence to test factual claims even in constitutional writ proceedings.
