Personal Bonafide Need

PLJ 2005 · Lahore High Court (Rawalpindi Bench)

This case was about a landlord-tenant dispute between Al-Hadeed Enterprises, a partnership firm, and Allied Bank of Pakistan, which was renting commercial shops and a basement in Islamabad to run a bank branch. When the lease expired, the landlord sought a higher rent, but after the bank did not agree, the landlord filed for eviction, claiming it needed the property for personal use and that the bank had defaulted on paying an enhanced rent. Both the Rent Controller and the Additional District Judge ruled in favor of the landlord and ordered the bank to vacate the premises.

The bank challenged this before the Lahore High Court, arguing that the lower courts had misread the evidence, that the landlord's real motive was to extract a higher rent rather than genuine personal need, that no proper notice of rent increase had been served to establish default, and that the eviction petition was invalid because it was filed by an unregistered partnership firm, which is barred under the Partnership Act.

The High Court agreed with the bank. It found that the claim of personal need was actually a pretext to force a steep rent hike, and that no notice of rent enhancement had been given, so no default could be proven. It also held that an unregistered firm cannot legally file an eviction case. The court therefore reversed the eviction order, protecting tenants from eviction based on improperly proven claims and procedural defects.
