Are the employees of Statutory Corporation entitled for promotion?
PLJ 2004 Tr. C. (Services) 261 · Islamabad High Court
This case was about whether Telephone Operators working in Pakistan Telecommunication Company Ltd (PTCL), a statutory corporation, were entitled to promotion from BPS-8 to BPS-11. A group of employees had been denied promotion despite meeting educational and experience requirements they believed qualified them, while a colleague in a similar position, Muhammad Akram, had earlier won a case before the same tribunal and was granted the promotion, a decision upheld by the Supreme Court.
The employees argued that PTCL's own notifications from 1992, 1995, and 1997 set out clear rules for promotion to BPS-11, and that these rules applied to all Telephone Operators across the company's system, not just those working in specific overseas exchanges. They contended that since Akram had been granted relief, they deserved the same treatment under identical rules.
The Federal Service Tribunal examined the relevant notifications and found that promotion to BPS-11 was indeed available to Telephone Operators throughout the PTCL system, based on either experience and qualifications for promotion, or separately through direct recruitment limited to overseas exchange postings requiring graduate qualifications and an English test. The tribunal directed PTCL to re-examine all the appellants' cases under this interpretation and decide on their eligibility for promotion within six months.
This case matters because it clarifies that employees of statutory corporations can claim promotion rights created by internal company notifications, and that such rights must be applied consistently across similarly situated staff.
