How conviction and sentence is determined in narcotics case?
PLJ 2004 SC 566 · Lahore High Court
This case involved Naseer Ahmad, who was convicted under Pakistan's narcotics control law for possessing and trafficking a large quantity of heroin (28 kg) and sentenced to death by a Special Judge of the Anti-Narcotics Force. His appeal to the Lahore High Court was dismissed, and he then sought leave to appeal before the Supreme Court.
The case began when a Filipino woman was arrested at Islamabad Airport with heroin, which she said she bought from the petitioner. This led authorities to other gang members, one of whom directed officials to raid the petitioner's house, where the heroin was recovered hidden inside steel rollers packed in cartons.
The petitioner argued that the narcotics were never produced in court, that his confession wasn't properly recorded, and that the law requiring independent witnesses during searches was violated. The Supreme Court rejected these arguments, noting the drugs had been lawfully destroyed by court order after trial, the confession met legal requirements, and police witnesses could be relied upon just like any other witnesses since their testimony withstood cross-examination.
The Court held that the combined evidence—eyewitness accounts, circumstantial evidence, and the confession—proved guilt beyond reasonable doubt, and that the petitioner was the ringleader of the smuggling operation. The petition was dismissed, and the conviction and death sentence were upheld. The judgment reinforces how courts weigh evidence, witness credibility, and procedural technicalities in serious narcotics cases.
