Statement of dead man is admissible
PLJ 2004 Lahore 1538 [Rawalpindi Bench Rawalpindi] · Lahore High Court (Rawalpindi Bench)
This case involved a dispute over pre-emption, a legal right allowing certain people (like co-sharers in land) to buy property that has been sold to someone else, by stepping into the buyer's shoes. Waris Khan filed a suit claiming he had a superior right to pre-empt the purchase of land by Muhammad Iqbal, arguing the actual sale price was lower than recorded and that he would suffer loss if denied the land. Waris Khan died during the proceedings, and his legal heirs continued the case.
To win a pre-emption suit, a plaintiff generally needed to prove he made the required legal demands (talbs) and, under the law as it stood at the time, also prove he would suffer genuine loss or need (zarar and zaroorat) without the land. The trial court and first appellate court both ruled that while the demands were technically made, there was no evidence proving loss or need, so the suit was dismissed.
The High Court agreed. It found that witnesses proved the demands were properly made, but no one testified about loss or need, including the deceased's own son, who took the witness stand but stayed silent on this point. The petitioners argued that statements in the original plaint and notice should count as evidence under a rule allowing dead persons' statements made in the ordinary course of business. The court rejected this, holding that filing a lawsuit or legal notice is not a business activity under that law, and pleadings alone are not evidence. The revision petition was dismissed.
