What if name of accused in column no 2 of challan

PLJ 2004 Cr.C. (Lahore) 348 · Lahore High Court

This case involved a man accused of murder under sections 302, 34, and 109 of the Pakistan Penal Code, arising from a violent incident during a village meeting where two people were shot dead. The complainant's original FIR named the petitioner as one of the shooters, firing at one of the deceased.

However, several things undermined the prosecution's case. The complainant kept changing and expanding his account over time, giving fresh statements that added more and more accused, eventually implicating 17 people in a later complaint, while the deceased's brother filed a separate complaint naming 12 accused. This inconsistency raised doubts about the reliability of the allegations.

More importantly, six different police officers investigated the case at various stages, and each one independently concluded that the petitioner was not present at the scene and was innocent. Based on this, the police placed his name in Column No. 2 of the police report (challan), meaning he was not recommended for prosecution despite being named in the FIR.

The Lahore High Court held that while police opinions are not admissible as evidence in court, they are still relevant when deciding bail, especially since the police report is the basis on which courts take cognizance of a case. Given the repeated findings of innocence and the inconsistent complainant versions, the court ruled this was a case requiring further inquiry and granted the petitioner bail, setting surety at Rs. 50,000.
