Judgment on confiscation of non custom paid vehicles

PLJ 2003 Lahore 628 (DB) · Lahore High Court

This Lahore High Court judgment dealt with dozens of customs appeals (87 cases decided together) concerning vehicles that had been seized by anti-smuggling authorities because no customs duty had been paid on them. The vehicle owners had applied to pay the required duties and fines to get their vehicles released, but Customs officials refused, citing a government notification (SRO 1374/1998) that barred such release for certain vehicles after a specified cut-off date. A lower appellate tribunal had sided with the owners, ordering the vehicles released on payment of fine and duty. The Customs Department challenged this before the High Court.

The High Court ruled in favor of Customs. It held that since the vehicles exceeded Rs. 50,000 in value and no duty had been paid, they qualified as smuggled goods under the law. While Section 181 of the Customs Act normally allows owners the option to pay a fine instead of losing their goods, this right is subject to exceptions that the Board of Revenue can specify—meaning certain goods can be excluded from that option altogether. The tribunal had ignored this restriction. The court also rejected the claim that a buyer was protected as an innocent purchaser, since there was no proof of a genuine purchase, and the burden of proving good faith lay on the possessor, which was not met.

As a result, the High Court set aside the order releasing the vehicles and restored their confiscation. The judgment matters because it clarifies that authorities' power to allow fines instead of confiscation is not absolute and can be restricted by official regulations.
