Concept of Independence of Judiciary in Pakistan
PLJ 2002 SC 120 · Lahore High Court
This Supreme Court case dealt with how Annual Confidential Reports (ACRs) - performance evaluations - should be written for judges in the subordinate judiciary of Punjab. The Lahore High Court had appealed against a decision of the Punjab Subordinate Judiciary Service Tribunal, which had ruled in favor of a judicial officer, K.M. Sohel, regarding adverse remarks entered in his ACRs.
The key questions were whether adverse remarks recorded after the government's prescribed time limit for writing ACRs become invalid, and whether judicial officers must be given a personal hearing before adverse remarks against them are finalized.
The Supreme Court held that the time frame set out in government instructions for writing ACRs is only directory, not mandatory, meaning missing the deadline does not automatically invalidate the report. The court reasoned that evaluating a judge's work is different from evaluating other government employees, since a judge's performance is reflected mainly through judgments that take time to be reviewed by higher courts. Because of this, a longer and more careful process is justified when assessing judicial officers.
The court also explained that judicial independence means not just freedom to decide cases without fear or favor, but also maintaining high standards of conduct and integrity. It suggested that High Courts, as independent institutions, could frame their own
