Exemption from Goods Exit Tax

PLJ 2001 SC 1263 · Lahore High Court

This case involved a dispute over whether a local government body, Zila Council Jhang, could impose an export tax on crushed stone produced by Daewoo Corporation, a South Korean company building a section of the National Highway Authority's Motorway Project.

Daewoo had been authorized to excavate stone from hills near Rabwah for the road construction. It extracted the raw stone from a quarry located within the territory of Town Committee Rabwah, but transported it to crushing plants located within the jurisdiction of District Council Jhang, where the stone was mechanically processed into crushed stone. The District Council then imposed an export tax on this crushed stone as it left its territory, which Daewoo challenged, partly by arguing it deserved constitutional protection as an entity connected to a government project.

The Supreme Court rejected Daewoo's claim of exemption, finding it was a private foreign company with no government ownership, control, or funding, and therefore could not claim the special constitutional protections available to government bodies.

On the core tax question, the Court held that because the crushing process transformed the raw stone into a new commodity, this amounted to production, giving District Council Jhang lawful authority to tax its export. The Court also ruled that a government-issued "model schedule" of tax rates was only a guideline, not binding, so the Council's notified rate of Rs. 2 per quintal was valid.

The judgment matters because it clarifies when local councils can tax goods leaving their territory, and confirms that companies working on public projects don't automatically gain government-level legal immunities.
