Power of Review exercised by Wafaqi Mohtasib

PLJ 2001 Lahore · Lahore High Court

This case involved a company, Kasur Oil Mills, that had taken a complaint to the Wafaqi Mohtasib (a federal ombudsman set up under a 1983 presidential order) seeking redress for its grievance. The Mohtasib initially dismissed the complaint, but after the company filed a review petition, the Mohtasib reversed course and ruled in its favor. The opposing party then challenged this reversal before the President of Pakistan, who accepted their representation and set aside the Mohtasib's revised decision. The company then went to the Lahore High Court, arguing that the President's order lacked proper reasoning and had been passed without giving it a personal hearing.

The High Court rejected these arguments and dismissed the petition. It held that the Wafaqi Mohtasib never had the legal power to review its own earlier decisions in the first place, since the governing law contained no provision allowing this. The court explained that the power of review is not a mere procedural matter but a question of jurisdiction, and such power must be expressly granted by law before it can be used. Since no such power existed, the President was right to set aside the Mohtasib's review order, and this itself counted as a valid reason. The court also held that the President was not legally required to grant a personal hearing in such appeals.

This ruling reinforces the principle that administrative bodies cannot assume powers, like reviewing their own decisions, unless explicitly authorized by statute.

ہائی کورٹ نے ان دلائل کو مسترد کرتے ہوئے درخواست خارج کر دی۔ عدالت نے قرار دیا کہ وفاقی مح
