Interest is un-islamic as per the declaration of Supreme Court

PLJ 2001 Lahore 790 · Lahore High Court

This case involved a man who had taken a loan from a government-linked finance corporation to build a house or buy equipment, agreeing to repay it in instalments. He had paid back nearly the full principal amount but the corporation was still demanding more money, which he argued was actually interest, something the Supreme Court of Pakistan had already ruled to be un-Islamic. He asked the Lahore High Court to intervene through a constitutional petition.

The court held that the petition itself was not maintainable, because the man had signed a loan agreement voluntarily and had other legal options available, such as approaching the corporation directly or filing a civil suit, instead of coming straight to a constitutional court. The court also noted it did not have authority to rule on whether interest violates Islamic law, since that falls under a special constitutional provision reserved for other forums. It also clarified that past, already-completed financial transactions could not be reopened even though interest had been declared un-Islamic.

Despite dismissing the petition on technical grounds, the judge directed the corporation to recalculate the man's dues fairly, apply any concessions or incentive schemes he might qualify for, and consider letting him pay in manageable instalments so he and his family would not be ruined. The judge also criticized finance institutions for aggressively pursuing poor borrowers while seemingly not acting against wealthy defaulters, calling this discriminatory, and asked the Ministry of Finance to create fairer recovery policies protecting both the institutions and poor borrowers.
