Jurisdiction of High Courts to issue writs
PLJ 2001 Lahore 560 · Lahore High Court
This case concerns a petition filed in the Lahore High Court by a citizen who wanted a criminal investigation transferred from one police officer to another. He approached the High Court under Article 199 of the Constitution, which allows courts to issue writs such as directions, declarations, habeas corpus, or quo warranto.
The court dismissed the petition at the outset. It explained that before a High Court can use its special constitutional powers under Article 199, it must be satisfied that no other adequate legal remedy exists. This is a basic requirement, not optional. In this case, the petitioner had another clear remedy: if unhappy with how an investigation was being conducted, he could complain to a higher-ranking police officer, since the police force has its own internal hierarchy under the Police Act and Rules to handle such matters.
The judge also explained the legal framework governing police investigations under the Criminal Procedure Code, noting that investigating crimes is the statutory duty and right of the police, not something courts should interfere with except in limited circumstances. Quoting earlier Privy Council and Supreme Court rulings, the judge stressed that courts and police perform complementary but separate functions, and that courts stepping into police investigation work would disrupt the proper functioning of the justice system.
This judgment matters because it reinforces the principle that constitutional writ jurisdiction is a last resort, not a substitute for available administrative remedies, and that police investigations should generally proceed without premature judicial interference.
