Scope of FIR during Civil Litigation

PLJ 2001 Lahore 1133 · Lahore High Court

This case involved a dispute between two people who ran a carpet business together. One party, Muhammad Younas, claimed that a sum of money was owed to him and that an agreement to sell had been signed, and he registered a criminal case (FIR) under Section 406 of the Pakistan Penal Code, which deals with criminal breach of trust, against Muhammad Abbas.

However, Abbas had already filed a civil suit earlier, challenging that very agreement, claiming his signature had been obtained by force. He argued that only after the complainant received court notices about this civil suit did the criminal case suddenly get registered against him, suggesting it was done to pressure him into dropping the civil case rather than because a real crime had occurred.

The Lahore High Court examined the FIR and the timeline of events and agreed that the criminal case appeared to be a tactic to turn a civil/business dispute into a criminal matter, apparently driven by bad faith and ulterior motives. While the court did not fully quash the FIR, it ruled that the criminal proceedings should be put on hold until the civil suit was finally decided.

This judgment matters because it reinforces a legal principle: when a dispute is essentially civil in nature (like unpaid debts or contested agreements) but someone tries to use criminal law as a pressure tactic, courts can pause the criminal case until the underlying civil matter is resolved, preventing misuse of the criminal justice system.
